Terms of service

These terms are the agreement between you and MedCally. By creating an account or paying for a consultation you accept them. Please read the emergency section and the section on prescriptions — those two matter most.
Emergencies
MedCally is not for emergencies. If something is happening right now — chest pain, trouble breathing, sudden weakness, slurred speech, heavy bleeding, thoughts of harming yourself — call 911 or go to the nearest emergency room. In the United States you can also call or text 988 for the Suicide and Crisis Lifeline.
We answer in hours, not seconds, and nobody is watching the inbox around the clock. Never wait on an answer from us when the situation is urgent.
What the service is
You describe your question in writing and attach whatever helps — a photograph, a lab report, a discharge summary. A physician licensed in your state reads it and writes back. You keep the answer in your account and can return to it whenever you need.
Every answer is written by a clinician. We do not send you text generated by software and present it as medical advice.
A written consultation has limits, and we tell you when you have reached one. Some questions need a physical examination, imaging, or lab work that no one can do over text. When yours is one of them, the doctor says so and tells you what to arrange locally.
Who may use it
You must be 18 or older and physically located in the United States when you write to us. Medicine is licensed state by state, so we can only take your question if one of our physicians holds a license in the state you are in. If nobody on our side is licensed where you are, we will tell you before you pay.
You may ask on behalf of someone you care for — a parent, a child, a partner. Say whose case it is in your first message, and confirm you have the authority to seek care for them. Nobody under 18 may hold their own account.
What a consultation includes
A consultation is one question and everything that follows from it. After a doctor answers, you can keep writing about that answer for seven days without paying again — ask what a term meant, send the result you promised, say the symptom changed.
Seven days after the last message the consultation closes on its own. The thread stays in your account to read. A question about something else starts a new consultation.
We aim to answer within one business day. That is a target, not a promise, and it is not part of what you are paying for. If a case takes longer because it went to a specialist, we tell you rather than leave you waiting.
Prescriptions
A doctor may prescribe when writing a prescription is appropriate for your case and permitted in your state. Nothing here entitles you to one, and paying for a consultation does not buy a prescription. If the doctor judges that a medication is wrong for you, they will explain why and what to do instead.
We do not prescribe controlled substances of any schedule. That includes opioids, stimulants prescribed for ADHD, benzodiazepines, sedatives and testosterone. Those require an in-person relationship that a written consultation cannot establish.
Prices and billing
A single consultation is $19.99, charged when you send the question. A subscription is $39.99 a month or $329.99 a year and includes three consultations each calendar month. Unused consultations do not carry into the next month.
Subscriptions renew automatically at the end of each period until you cancel. Cancel any time from your profile; you keep access until the period you already paid for runs out, and we do not charge you again. Prices may change, and we will tell you at least 30 days before a change affects an existing subscription.
Payments are handled by our payment processor. We never see or store your full card number.
Refunds
If we cannot take your question — no licensed physician in your state, or the question needs care we cannot give in writing — you are not charged, and any payment already taken comes back to you.
If you paid and did not get an answer, write to us and we return the payment. Once a doctor has read your case and written back, that consultation has been delivered and is not refundable, even when the answer was not the one you hoped for. Annual subscriptions can be refunded pro rata within 30 days of purchase if you have not used a consultation.
Your account
Keep your password to yourself. Anything written from your account is treated as coming from you, and you are responsible for it.
Your answer is only as good as what you tell the doctor. Give your real age, your actual medications, your real history — including the parts that are awkward. Leaving something out can make an answer wrong in a way nobody catches.
How the service may be used
Do not use MedCally to obtain a specific medication you have already decided on, to build a record for a legal or insurance claim, or to abuse the people answering you. Do not upload anyone else’s medical records without their permission. Do not copy the medication reference wholesale to republish it.
We may end an account that does these things. If money is left on it, we return it.
The medication reference
Our medication pages are drawn from the FDA’s public label database and the National Library of Medicine. They are reference material, not advice about you. A label describes a drug in general; only a clinician who knows your case can say what it means for you.
Labels change, and our copy can lag behind the source. Never start, stop or change a dose because of something you read on those pages.
Your records
Consultations stay in your account so you can read them again, show them to another doctor, or check what you were told a year ago. We keep the medical record of a consultation for as long as state law requires us to, which in most states is at least seven years after the last contact.

Closing an account
You can close your account from your profile at any time, and you do not have to tell us why. Closing it cancels an active subscription at the end of the paid period.
We may suspend an account that breaks these terms, and we may stop offering the service entirely. If we do, we will give you notice and time to save what is in your account.
Limits on our liability
The doctors who answer you are responsible for their own clinical judgment, and they carry professional liability cover. Nothing in this section limits what you are owed when someone is negligent — no agreement can waive that, and we are not trying to.
For everything else — the software, the website, the reference pages — the service is provided as it is. We do not promise it will be available without interruption or free of errors. Except where the law does not allow it, our total liability for any claim related to the platform is limited to what you paid us in the twelve months before the claim.
Governing law and disputes
These terms are governed by the law of the United States and of the state in which MedCally is established, without regard to conflict-of-law rules.
If something goes wrong, write to us first — most problems are settled in an email. Where that fails, either of us may bring the matter before the courts of that state. You are not required to arbitrate, and you are not giving up the right to join others in a claim.
Changes to these terms
We will update this page when the service changes, and the date at the top will tell you when. For changes that affect what you pay or what you are owed, we will email you at least 30 days beforehand. Continuing to use MedCally after a change means you accept the new version.
